Relatório de estágio curricular no Juízo Central Criminal de Lisboa

Abstract

The subject of this report, “Child Pornography - Analysis of Article 176 of the Penal Code and Controversial Issues”, arose during a curricular traineeship held at the Central Criminal Court of the District of Lisbon. This report aims to analyze the dubious issues surrounding the child pornography in the current Portuguese legal regime, based on an investigation, a case law analysis and a doctrinal study. Thus, issues such as the classification of the legal asset in question, the definition of the objective and subjective type and the materialization of the concourse of infractions under analysis will be discussed. This thesis aims to adopt a logical line of reasoning, which allows a coherent discussion about the topic in order to reach a reasoned final position concerning each of the problems inherent in the child pornography.

O tema deste relatório, “Pornografia de Menores – Análise do artigo 176.º do CP e Questo~es Controversas”, surgiu durante um estágio curricular realizado no Juízo Central Criminal de Lisboa. Este relatório visa a análise das questões dúbias que circundam a pornografia de menores no atual regime jurídico português, tendo por base uma investigação, uma análise jurisprudencial e um estudo doutrinário. Desta forma, serão discutidas questões como a classificação do bem-jurídico em causa, a definição do tipo objetivo e subjetivo e, ainda, a concretização da matéria do concurso no crime em análise. O objetivo será adotar uma linha de raciocínio lógico, que permita uma discussão coerente sobre o tema no sentido de atingir uma posição final fundamentada relativamente a cada uma das problemáticas inerentes à pornografia de menores.
