Relatório de estágio curricular no Juízo de Instrução Criminal de Braga

Abstract

This report was written as part of a curricular internship carried out at the Judicial Court of the Braga District – Braga Pre-trial Court, which lasted four and a half months. Throughout the internship, it was possible to come into direct contact with several issues related to criminal proceedings, specifically, in the investigation and pre-trial stages. Thus, after the daily tracking of some proceedings, regarding the investigation stage, and following the research and analysis of the consulted processes, this work consists in a study, above all, practical and theoretical of the institute of statements for future memory in the crime of child sexual abuse. This report focuses on the investigation of the current regime of statements for future memory and, mainly, on the situations and problems of the use of this evidence in the child sexual abuse, which were observed during the internship. In addition to the scientific subject of this theme, this report portrays the experience gained in the internship carried out in the Braga Pre-trial Court, first referring to the structure and competence of the internship location and then describing the activities developed and the predominant crimes when carrying out the internship. In summary, the aim of this report is to present, based on the proceedings assisted in the internship and with the consultation carried out in the jurisprudence and in the doctrine, a global view on the controversial issues that have arisen, and have been arising, in the system of statements for future memory, specially, in the crime of child sexual abuse.

O presente relatório foi elaborado no âmbito de um estágio curricular realizado no Tribunal Judicial da Comarca de Braga – Juízo de Instrução Criminal de Braga, com a duração de quatro meses e meio. No decorrer do estágio, foi possível entrar em contacto direto com diversas questões referentes ao processo penal, especificamente, nas fases de inquérito e de instrução. Desta forma, após o acompanhamento diário de várias diligências, relativas à fase de inquérito, e posterior pesquisa e análise dos processos consultados, este trabalho consubstancia-se num estudo, sobretudo, prático e teórico do instituto das declarações para memória futura no crime de abuso sexual de crianças. Este relatório atenta para a investigação do regime atual das declarações para memória futura e, principalmente, para as situações e problemáticas da utilização deste meio de prova no crime de abuso sexual de crianças, que foram verificadas ao longo da realização do estágio. A par do estudo científico desta temática, o presente relatório retrata a experiência obtida no estágio efetuado no Juízo de Instrução Criminal de Braga, referindo, primeiramente, a estrutura e a competência do local do estágio e, de seguida, descrevendo as atividades desenvolvidas e a criminalidade predominante aquando da realização do mesmo. Em síntese, o que se pretende com este relatório é apresentar, com fundamento nas diligências assistidas no estágio e com a devida consulta efetuada na jurisprudência e na doutrina, uma visão global sobre as questões controversas que surgiram, e têm vindo a surgir, no regime das declarações para memória futura, especialmente, no crime de abuso sexual de crianças.
