O presente relatório é a materialização escrita de um estágio curricular realizado no Tribunal Judicial da Comarca de Coimbra - Juízo Central Criminal de Coimbra, entre Setembro e Dezembro de 2024, no qual tive a oportunidade de acompanhar diariamente o juiz supervisor e os trabalhos do coletivo que integrava, tanto como juiz presidente como juiz adjunto do tribunal coletivo.
Este relatório de estágio encontra-se dividido em duas partes, sendo a primeira uma descrição das diferentes componentes do estágio e a segunda dedicada a um estudo teórico-prático e crítico da Lei nº 38-A/2023, de 2 de agosto, que estabelece um perdão de penas e amnistia de infrações por ocasião da realização em Portugal da Jornada Mundial da Juventude. Irá analisar-se, entre outros aspetos, a sua
(in)constitucionalidade material, o seu conteúdo e alguns dos problemas teóricos e práticos que a sua aplicação suscita.
This report is the written materialization of a curricular internship conducted at the Judicial Court of the District of Coimbra - Central Criminal Court of Coimbra, between September and December 2024, during which I had the opportunity to follow the daily work of the supervising judge and the collective court, both as presiding judge and associate judge. This internship report is divided into two parts: the first presents a description of the various components of the internship, and the second is dedicated to a theoretical, practical, and critical study of Law Nº 38-A/2023, dated August 2nd, which establishes a pardon of sentences and an amnesty for offenses in connection with the World Youth Day held in Portugal. It will analyze, among other aspects, its (un)constitutionality, its content, and some of the theoretical and practical issues that arise from its application.
