Este relatório resulta de um estágio curricular realizado no Juízo Central Criminal de Sintra, onde surgiu o tema central deste estudo: a questão da admissibilidade da valoração das declarações para memória futura prestadas pelas vítimas de violência doméstica no inquérito, quando estas se recusam a depor em julgamento. Numa primeira parte, apresento as atividades realizadas durante o estágio. Na segunda, desenvolvo o objeto deste trabalho e outras questões preliminares essenciais que estão com ele relacionadas. Inicialmente, analiso a natureza pública do crime de violência doméstica e defendo a suspensão provisória do processo como forma de mitigar os seus efeitos. Em seguida, desenvolvo o direito de recusa das vítimas de violência doméstica e exponho as propostas legislativas destinadas a atenuar os impactos negativos desta prerrogativa na punição deste crime, concluindo pela preferência na sua manutenção e pela inadmissibilidade da valoração de todas as declarações prestadas anteriormente quando a vítima faz uso desse seu direito em julgamento, com exceção das declarações para memória futura. No terceiro capítulo, analiso o regime das declarações para memória futura prestadas pelas vítimas de violência doméstica no inquérito, sustentando que o juiz de instrução criminal deve, por regra, deferir os pedidos para a recolha desta prova antecipada e que a reinquirição da vítima em julgamento deve ocorrer apenas em casos excecionais. No último capítulo, argumento que esta prova antecipada pode e deve ser valorada em julgamento, mesmo quando a vítima de violência doméstica se recusa a depor nessa fase processual. O objetivo deste trabalho é, através de uma extensa análise da doutrina, jurisprudência e soluções adotadas por outros ordenamentos jurídicos,
contribuir para uma prática judicial mais uniforme, eficaz e comprometida com a punição da violência doméstica.
This report is the result of a curricular internship at the Central Criminal Court of Sintra, where the central theme of this study emerged: the admissibility of statements for future reference made by the victim of domestic violence during the investigation, when they refuse to testify at trial. In the first part, I present the activities carried out during the internship. In the second, I develop the subject of this work and other essential preliminary issues related to it. Initially, I analyze the public nature of the domestic violence crime and defend the provisional suspension of the proceedings as a way of mitigating its effects. Next, I develop the right of domestic violence victims to refuse to testify and present the legislative proposals aimed at reducing the negative impacts of this prerogative on the prosecution of this crime, concluding in favor of maintaining this right and against the admissibility of any prior statements when the victim exercises this right at trial, except for statements for future reference. In the third chapter, I analyze the legal framework of statements for future reference provided by victims of domestic violence during the investigation, arguing that the criminal investigation judge should, as a rule, grant requests for the collection of such evidence and that the victim's re-examination at trial should only occur in exceptional cases. In the final chapter, I argue that this statements for future reference can and should be assessed at trial, even when the victim refuses to testify during that procedural stage. The objective of this study is to contribute, through an extensive analysis of legal doctrine, case law, and solutions adopted in other legal systems, to a more uniform, effective, and committed judicial practice in the prosecution of domestic violence.
