De que forma é que o lobby influencia a regulamentação tecnológica na União Europeia?

Abstract

Esta dissertação centra-se nas ligações entre a regulamentação do lobby tecnológico e a sua atividade na União Europeia, com um foco particular na inteligência artificial. Pretende-se explorar a forma como o lobby influencia as políticas e a legislação que é produzida, na sequência de movimentos lobistas junto das instituições europeias (Parlamento, Comissão e Conselho). A pergunta de partida é “De que forma o lobby influencia a regulamentação tecnológica na União Europeia?” A escolha do lobby como objeto de estudo baseia-se na influência que este pode ter junto dos decisores políticos e, consequentemente, afetar as legislações que regem as vidas de todos os cidadãos da União Europeia, tendo também um impacto, possivelmente, mundial devido ao “Efeito Bruxelas”. As Relações Internacionais, quadro de formação em que se insere esta dissertação de mestrado e o tema do lobby tecnológico, aliado à escolha das fontes e dos atores - instituições europeias e protagonistas de Organizações Não-Governamentais – é onde se enquadra a mesma. A abordagem utilizada, é, naturalmente, a pesquisa bibliográfica e uma metodologia qualitativa. Neste caso, o recurso a entrevistas a vários especialistas da área, tanto teóricos, como pessoas que trabalham em Organizações Não-Governamentais ligadas ao controlo do lobby e também a uma pessoa que trabalha numa das Big Tech. Procurando assim provar a premissa de que o lobby é de facto eficaz na persuasão e tem impacto na produção legislativa da UE. Este estudo evidencia a ligação que a regulamentação, que foi aprovada com o AI Act em março de 2024, tem com o lobby, que este teve um papel decisivo junto dos decision-makers antes da aprovação da lei.

This dissertation focuses on the links between the regulation of technological lobbying and its activity in the European Union, with a focus on artificial intelligence. It aims to explore how lobbying influences political issues and the legislation that emerges as a result of lobbyists' movements within the European institutions (European Parliament, Commission and Council). The starting question is ‘In what way does lobby influence the regulatory process in the European Union?’ The choice of lobbying as study object is based on the influence it can have on political decision-makers and, consequently, affect the legislation that governs the lives of all citizens of the European Union, possibly also having a worldwide impact due to the ‘Brussels Effect’. The approach used is, naturally, bibliographical research and a qualitative methodology. In this case, interviews with various experts in the field, both theoreticians and people who work in Non-Governmental Organisations linked to the control of lobbying, as well as a person who works in one of the Big Tech companies, were used. The aim was to prove the premise that lobbying is indeed effective in persuading and having an impact on the EU's legislative output. This study concludes that, in fact, there is a clear link between the regulation that was passed with the AI Act in March 2024 and lobbying, which played an essential role in influencing decision-makers before it was passed.
