Prostituição: Consentimento à alienação e nulidade do Objeto Contratual

O objeto desta dissertação é a prostituição, a forma como ela tem sido definida conceptualmente e como se poderá traduzir numa definição jurídica. As definições e linguagens liberais serão questionadas e contestadas através de uma crítica feminista que apreende a prostituição enquanto um sistema baseado e, simultaneamente, perpetuador da hierarquia sexual e de desigualdades sociais variadas. A proposta de legalização da prostituição enquanto trabalho ou profissão será analisada teoreticamente à luz da (in)compatibilidade com a) os princípios gerais do direito privado contratual, b) o direito do trabalho c) o direito internacional e europeu e, d) a tipificação criminal do lenocínio em Portugal. Irá ser analisada a natureza e a formação do consentimento prestado no seio da prostituição bem como qual o objeto contratual do negócio numa resistência deliberada às teorias que o equiparam à prestação de serviços. Após essa estruturação, o objeto contratual será analisado à luz do direito privado e da (in)conformidade com o Ordenamento Jurídico português, e do regime da nulidade - nomeadamente por prever a sujeição a violência, a ofensa a bens jurídicos com tutela penal, entre os quais, a liberdade
e a autodeterminação sexual, a saúde, a integridade pessoal, física e psíquica e por comprometer o princípio basilar da dignidade humana. Será abordada a possibilidade de implementação do modelo abolicionista nórdico sueco em Portugal e, em concreto, serão sugeridas as necessárias adaptações ao contexto sociocultural do país na senda do combate ao tráfico humano, do respeito pelos direitos humanos e da prossecução da igualdade entre homens e mulheres.
The subject of this dissertation is prostitution, the way it has been conceptually defined, and how it might be translated into a legal definition. Liberal definitions and languages will be questioned and contested through a feminist critique that views prostitution as a system that is both based on and perpetuates sexual hierarchy and various social inequalities. The proposal to legalize prostitution as a job or profession will be theoretically analyzed in light of its (in)compatibility with a) the general principles of private contractual law, b) labor law, c) international and European law, and d) the criminal classification of pimping in Portugal. The nature and formation of consent given within prostitution will be examined, as well as the contractual object of the transaction, in deliberate resistance to theories that equate it with the provision of services. After this structuring, the contractual object will be analyzed in the light of private law and its (in)conformity with the Portuguese Legal System, and the regime of nullity—namely by foreseeing subjection to violence, offense to legally protected rights, including sexual self-determination, health, physical and mental integrity, and by compromising the fundamental principle of human dignity. The possibility of implementing the Swedish Nordic abolitionist model in Portugal will be addressed, and specifically, the necessary adaptations to the country's socio-cultural context will be suggested in the pursuit of combating human trafficking, respecting human rights, and promoting equality between men and women.
