A Política Digital Europeia e Portugal: O Legado da IV Presidência Portuguesa do Conselho de da União Europeia

O Estágio na Estrutura de Missão Portugal Digital teve como principal objetivo acompanhar a Agenda Digital da IV Presidência Portuguesa do Conselho da UE (PPUE 2021), uma das medidas previstas no Plano de Ação para a Transição Digital (PATD). As interligações entre a dimensão nacional e europeia da Política Digital observadas durante a PPUE 2021 sugeriu que a reflexão teórica posterior ao estágio indagasse sobre o eventual impacto da PPUE 2021 no avanço da Política Digital Europeia, tendo como principais eixos problemáticos (i) a análise dos processos legislativos e não legislativos da Política Digital Europeia e (ii) o papel desempenhado pelas Presidências Rotativas, tendo em conta os seus poderes e restrições. Neste enquadramento, é efetuada uma breve referência histórica sobre a intervenção das autoridades europeias nas tecnologias digitais, onde se constata que, inicialmente, estas eram encaradas como um importante meio de suporte à concretização da sua “política-mãe”, o Mercado Único. No entanto, com o avançar das décadas, esta política foi-se progressivamente autonomizando, ganhou uma dimensão própria, e tornou-se um pilar na estratégia de desenvolvimento global da União Europeia. Para validar o contributo da PPUE 2021 neste processo, são analisados os poderes e limites das Presidências Rotativas do Conselho da UE, designadamente a sua maior ou menor capacidade de Agendamento e de impulso dado aos processos legislativos de negociação, mecanismo este que foi alvo de uma alteração profunda com o “Tratado de Lisboa”. A análise atenta da Agenda Digital da PPUE 2021, permite constatar que esta obteve resultados concretos em vários domínios, nomeadamente na promoção da conectividade internacional, na investigação e inovação, na cibersegurança, na privacidade, na literacia digital, na saúde, e na modernização da administração pública. Concluiu-se, por isso, que a PPUE desempenhou um papel importante na liderança e coordenação das atividades do Conselho da UE em matéria de Política Digital, e por isso deixa um legado significativo na preparação da Europa para a Era Digital.
The main objective of the Internship in the Portugal Digital Mission Structure was to monitor the Digital Agenda of the IV Portuguese Presidency of the EU Council (PPUE 2021), one of the measures provided for in the Action Plan for the Digital Transition (in Portuguese: “Plano de Ação para a Transição Digital” - PATD). Motivated by the positive experience of its previous presidencies, strongly committed to the European integration, but highly constrained by the limitations caused by the COVID-19 pandemic, PPUE 2021 had digital as one of its priorities. To analyse how the PPUE 2021 Digital Agenda may have contributed to the advancement of the Single Digital Market Strategy and the European Digital Strategy, a brief historical reference is made on the introduction of the Digital Policy in the European Union, where it is verified that it was initially seen to conclude its “mother policy”, the Single Market. However, as the decades progressed, it was emancipated, becoming a policy with its own dimension, and became a pillar of EU’s global development strategy. It also analyses the relevant role that the Rotating Presidencies of the Council of the EU have in advancing the EU legislative process, impacted by the “Lisbon Treaty”, which introduced changes to its functioning, namely the introduction of the Trio of Presidencies system and the loss of some of its powers. In this sense, using as problematic axes the role played by the Rotating Presidencies in the EU legislative process, taking into account their powers and limitations, and by tracking the process of the dossiers that formed the PPUE 2021 Digital Agenda, it is possible to see that it obtained concrete results across the board, namely in the promotion of international connectivity, research and innovation, cybersecurity, privacy, electronic justice, digital literacy, health, teleworking and the modernization of public administration. It is concluded, then, that the IV rotating Presidency of the Council of the EU played an important role in leading and coordinating the activities of the Council of the EU in digital matters, and thus promoting the advancement of the European Digital Policy.
