Com a sua crescente utilização, litígios que não podem ser resolvidos através de meios tradicionais tornar-se-ão mais comuns. Embora tenham o potencial de revolucionar a execução contratual, representam também um desafio ímpar em termos de resolução de conflitos. O seguinte estudo irá analisar as vantagens e desvantagens da resolução de litígios de smart legal contracts através de arbitragem internacional, o papel das instituições de arbitragem internacional na adaptação à utilização deste tipo de tecnologia e o seu impacto no desenvolvimento da arbitragem internacional. Além de explorar a arbitragem internacional como solução para litígios que involvam smart legal contracts, este estudo examinará também o possível papel da inteligência artificial (AI) na tomada de decisões e gestão do processo arbitral. O estudo analisará os seus benefícios e desafios, assim como o potencial impacto no na escolha e papel dos árbitros e os desafios em assegurar transparência e responsabilização. A investigação também examinará as implicações legais e éticas da utilização de IA na tomada de decisões, incluindo questões de parcialidade, privacidade e responsabilidade.
