Tendo como norte as más condições de trabalho e vida dos pescadores a bordo
de embarcações pesqueiras ao redor do mundo, este estudo analisa o complexo e
multifacetado setor da pesca, se debruçando sobre diversas questões direta ou
indiretamente interligadas às condições de trabalho na indústria pesqueira, inclusive as
organizações e instrumentos internacionais pertinentes, onde a Convenção n.° 188 da
Organização Internacional do Trabalho relativa ao trabalho no setor da pesca encontra
especial destaque.
Para tanto, seu capítulo inicial se dedica a conhecer e entender a importância, as
principais características e as formas de funcionamento do setor global da pesca, sendo
atribuído foco à pesca de captura marítima comercial, uma vez que é a área onde está
concentrada a maior parte dos problemas que abordaremos e para a qual a Convenção
n.º 188 é especialmente voltada.
Por sua vez, o segundo capítulo trata das práticas ilícitas, fraudulentas,
criminosas, abusivas, cruéis e desumanas que ocorrem no setor da pesca, afetando
diretamente as condições de trabalho, vida e a dignidade humana dos pescadores. Nesse
sentido, são analisadas questões como fisheries crimes, pesca ilegal, não declarada e não
reportada, tráfico de pessoas para o trabalho forçado e suas relações com determinados
instrumentos internacionais e com a atuação das agências multilaterais.
O terceiro capítulo se debruça especificamente sobre a Convenção n.º 188,
trazendo seu enquadramento histórico, seus aspectos centrais e relacionando seus
dispositivos aos abusos e explorações sofridos pelos pescadores.
Por fim, são então apresentadas as conclusões finais.
Bearing in mind the poor working and living conditions of fishermen on board fishing vessels around the world, this study analyzes the complex and multifaceted fisheries sector, addressing several issues directly or indirectly linked to working and life conditions and the human dignity in the fishing industry, including relevant international institutes and instruments, where International Labour Organization Convention No. 188 on Work in Fisheries (2007) is particularly prominent. To this end, its initial chapter is dedicated to knowing and understanding the importance, the main characteristics and the ways of functioning of the global fisheries sector, with a focus on commercial maritime capture fishing, which is the area that concentrates most of the problems which we will address and to which ILO Convention No. 188 is especially focused. In turn, the second chapter deals with illicit, fraudulent, criminal, abusive, cruel and/ or inhumane practices that occur in the fishing industry and directly affect fishermen. In this sense, issues such as fisheries crimes, illegal, unreported and unreported fishing, trafficking in persons for forced labor and their relations with certain international instruments and with the performance of multilateral agencies are analyzed. The third chapter focuses on Convention No. 188, bringing its historical framework, its central points and relating its devices to the abuses and exploitations suffered by fishermen. Finally, the final conclusions are presented.
