Num mundo do trabalho cada vez mais divergente do anteriormente concebido, a Diretiva 2019/1152 surge como resposta aĢ s novas exigĆŖncias de proteção dos trabalhadores, reforƧando direitos relativos aĢ previsibilidade e transparĆŖncia das condiƧƵes de trabalho. Esta dissertação de mestrado propƵe uma anaĢlise da Diretiva (UE) 2019/1152, com foco principal no artigo 9.Āŗ, que regula o "emprego paralelo".
Neste sentido, eĢ detalhado o alcance da proibição unilateral de claĢusulas de exclusividade que impedem os trabalhadores de exercerem atividades paralelas, salvo em situaƧƵes devidamente justificadas. SĆ£o desenvolvidos os fundamentos objetivos que podem legitimar exceƧƵes a esta proibição, como a saĆŗde e a seguranƧa, a proteção do sigilo comercial, a integridade do serviƧo pĆŗblico e evitar conflitos de interesses, explicando qual o seu significado e como eĢ que estes se situam no quadro jurĆdico da UniĆ£o Europeia.
A dissertação desenvolve o significado destes fundamentos ao discutir a forma como refletem valores fundamentais do Direito da União.
In a labour world that is increasingly divergent from what was previously conceived, Directive 2019/1152 has emerged as a response to new demands for worker protection, reinforcing rights relating to the predictability and transparency of working conditions. This master's thesis proposes an analysis of Directive (EU) 2019/1152, with the main focus on Article 9, which regulates āparallel employmentā. In this regard, the scope of the unilateral prohibition of exclusivity clauses that prevent workers from exercising parallel activities, except in duly justified situations, is detailed. The objective grounds that can legitimise exceptions to this prohibition are developed, such as health and safety, the protection of business confidentiality, the integrity of the public service and the avoidance of conflicts of interest, explaining what they mean and how they fit into the European Union's legal framework. The dissertation develops the meaning of these grounds by discussing how they reflect fundamental values of EU law.
