| dc.description.abstract | O artigo 107 (1) do Tratado sobre o Funcionamento da União Europeia constitui um dos poucos artigos que não sofreu alterações significativas desde a entrada em vigor do Tratado de Roma a 1 de Janeiro de 1958. Embora a proibição geral de intervenção do Estado na economia tenha permanecido praticamente inalterada ao longo dos anos, a mesma lógica não se aplica ao instrumento relativo ao controlo dos auxílios estatais (i.e., ao quadro regulamentar substanciado em legislação secundária), que tem vindo a evoluir constantemente. Examinando a resposta adotada pela Comissão Europeia, no seu papel como autoridade de aplicação da lei da concorrência, na gestão da Crise Financeira Global e da atual crise COVID-19 em curso, esta dissertação analisa a mudança na perceção do instrumento da política de auxílios estatais ao longo dos anos, considerando o seu papel em tempos de crise. O objetivo final desta dissertação é proporcionar uma resposta à pergunta: ‘Existe um quadro de emergência "típico" para a ajuda estatal ou cada crise é um acontecimento específico que requer uma resposta específica? Os Quadros Temporários têm como único objetivo resolver uma situação de emergência ou há algum objetivo(s) adicional(is)?’. | pt_PT |
| dc.description.abstract | Article 107 (1) of the Treaty on the Functioning of the European Union (“TFEU”) constitutes one of the few articles that has not changed significantly since the Treaty of Rome came into force on 1 January 1958. While the general prohibition of State intervention in the economy has remained barely unchanged over the years, the same rationale does not apply to the instrument of State aid control (i.e., the regulatory framework encapsulated in secondary legislation), which has constantly been evolving. This dissertation analyzes the shift in the perception of the State aid policy instrument through the years, considering its role in times of crisis, while examining the response adopted by the European Commission (“EC”), in its role as competition law enforcement authority, in the management of the Global Financial Crisis (“GFC”) and the current unfolding COVID-19 crisis. The ultimate goal of this dissertation is to provide an answer for the question: ‘Is there a ‘typical’ emergency framework for State aid, or is each crisis a specific event that requires a specific response? Are Temporary Frameworks solely aimed at solving an emergency situation or are there any additional objective(s)?’. | pt_PT |
