It precedes the presentation of the legal instruments for the materialization of this guarantee, to analyze some characteristics related to the benefit rights. The mechanisms inherent in this social right provided for in the Brazilian and Portuguese legal orders are analyzed. From the examination of the constitutional and infraconstitutional devices of regency, a search is made for the most adequate understanding about the legitimate beneficiaries of Justice Free in the Brazilian order. Lastly, there are reasons against the subjective and excessive deference of the exemption of expenses to be part of a judicial process.O presente trabalho pretende analisar a garantia fundamental do Acesso à Justiça, sobretudo seus aspectos voltados aos carentes de recursos financeiros. Antecede a apresentação dos instrumentos jurídicos para a materialização desta garantia, esmiuçar algumas características relacionadas aos direitos prestacionais. Analisa-se, então, os mecanismos inerentes a este direito social previstos nas ordens jurídicas brasileira e portuguesa. A partir do exame dos dispositivos constitucionais e infraconstitucionais de regência, busca-se o entendimento mais adequado acerca dos legítimos beneficiários da Gratuidade de Justiça no ordenamento brasileiro.
