Para tanto, o presente estudo passa pela construção do caráter autónomo e uniforme desse instrumento, bem como investiga as diversas facetas do conceito de ordem pública e a sua aplicação em diferentes jurisdições. No final, com a conjugação da teoria e prática, busca-se determinar se a ordem pública é mesmo uma solução indispensável, um obstáculo real à eficácia da arbitragem ou, ainda, se é possível encontrar um denominador comum para abordá-la de forma mais neutra e expectável.This work essentially aims to address the following question: what does “public policy” ultimately mean in international arbitration, and to what extent is this concept compatible with the pro-enforcement policy underlying the New York Convention? For this purpose, the present study encompasses the construction of the autonomous and uniform nature of this instrument, while investigating the various dimensions of the concept of public policy and its application in different jurisdictions.
