O estudo centra-se nas implicações da violência doméstica na determinação do regime das responsabilidades parentais, temática com a qual tive contacto frequente ao longo do estágio, tanto na observação de diligências processuais quanto na análise de processos judiciais. A relevância deste tema justifica-se, por um lado, pelo aumento significativo dos índices de violência no contexto familiar em Portugal e, por outro, pela complexidade das soluções jurídicas aplicáveis, dada a vulnerabilidade das vítimas e a necessidade de uma abordagem que assegure uma proteção eficaz. Neste sentido, o presente trabalho visa aprofundar a compreensão das questões jurídicas associadas à regulação das responsabilidades parentais em casos de violência doméstica, com especial enfoque nos principais instrumentos normativos, destacando-se a Convenção de Istambul, ratificada por Portugal em 2013. Este relatório integra os conhecimentos teóricos e a experiência prática adquiridos durante o estágio, aliando a análise jurídica à observação empírica. O estudo propõe-se, em primeiro lugar, a examinar o tratamento jurídico da regulação das responsabilidades parentais em contextos de violência doméstica e, em seguida, a avaliar a adequação e efetividade das soluções normativas vigentes na tutela das vítimas, em particular das crianças, à luz dos princípios fundamentais do Direito da Família, tanto na ordem jurídica nacional quanto no quadro normativo internacional.This report is based on the curricular internship carried out at the Family and Minors Court of Lisbon, as part of the non-academic component of the Master's in Forensic Law and Arbitration at NOVA School of Law. The study focuses on the implications of domestic violence in determining parental responsibility arrangements, a subject i frequently encountered during the internship, both through the observation of procedural diligences and the analysis of judicial cases. The relevance of this topic is justified, on the one hand, by the significant increase in domestic violence rates in Portugal and, on the other, by the complexity of the legal solutions applied, given the vulnerability of victims and the need for an approach that ensures effective protection. In this regard, the present work aims to deepen the understanding of legal issues related to the regulation of parental responsibilities in cases of domestic violence, with particular emphasis on the main legal instruments, notably the Istanbul Convention, ratified by Portugal in 2013. This report integrates theoretical knowledge with practical experience acquired during the internship, combining legal analysis with empirical observation.
